These Booking Terms and Conditions apply to bookings made with Undiscovered Mountains France. They should be read together with the holiday description, quotation or booking page, the Booking Confirmation and any special conditions expressly agreed in writing.
Undiscovered Mountains France ("UMF", "UM", "we", "us" or "our") is SARL Undiscovered Mountains France, a French limited liability company with share capital of EUR 10,000, whose registered office is at 26 rue de la Carrière, 05130 Jarjayes, France, RCS Gap / SIREN 853 529 493, SIRET 85352949300019 and VAT number FR48853529493.
Atout France registration number: IM005200005.

These terms apply to travel services and package holidays sold by UMF. Where a quotation, Booking Confirmation or written special condition expressly varies these terms, that specific written term will prevail to the extent permitted by mandatory law.
Where the Client is booking in the course of a business, school, club or other professional activity, additional contractual terms may apply. Mandatory rights that apply specifically to consumers or travellers remain unaffected where applicable.
"Client" or "you" means the person who makes the Booking and contracts with UMF. Where the Booking is for more than one traveller, the Client is the lead booker unless UMF agrees otherwise in writing.
"Traveller" means any person entitled to travel on the basis of the Contract.
"Booking Request" means a request submitted to UMF to book the travel services described in the quotation, holiday page or booking process.
"Booking Confirmation" means UMF's written confirmation that the Booking Request has been accepted.
"Contract" means the contract between UMF and the Client comprising these terms, the Booking Confirmation, the agreed holiday description or quotation, the Special Terms and Conditions applicable to the holiday and any other written special conditions accepted by UMF.
"Package" means a package within the meaning of the French Tourism Code (Code du tourisme).
"Departure Date" means the first date on which the travel services included in the Contract are due to begin.
"Deposit" means the amount payable on booking and any additional staged deposit expressly stated in the Booking Confirmation.
"Special Terms and Conditions" means the holiday-specific terms shown or supplied for a particular holiday and accepted by the Client as part of the booking process. They may include matters such as minimum participant numbers, specific activity requirements, dates, inclusions, exclusions or other conditions particular to that holiday.
Before the Client is bound by a Contract, UMF will provide the pre-contract information required by the French Tourism Code, including the main characteristics of the travel services, the total price and any known additional charges, payment arrangements, cancellation terms, minimum participant requirements where applicable, and the relevant standard information form for package travel.
The Client is responsible for checking the holiday description, dates, names, party composition, activity level, inclusions, exclusions, price and any special requirements before submitting the Booking Request. The online booking process will allow the Client to identify and correct input errors before placing the order.
Submission of a Booking Request and payment of a Deposit or other amount does not by itself mean that UMF has accepted the Booking. UMF may need to confirm accommodation, guides, activities or other services with suppliers.
The Contract is formed when UMF sends the Booking Confirmation to the Client. UMF will normally send the Booking Confirmation within 14 days of receiving the Booking Request. If UMF cannot accept the Booking, any amount paid for that Booking Request will be refunded without undue delay.
If UMF proposes an alternative before confirming the Booking, the Client is free to accept or reject it. If accepted, the alternative becomes the basis of the Contract.
The Client must check the Booking Confirmation promptly and notify UMF as soon as possible of any factual error or discrepancy.
There is no general 14-day cooling-off right for accommodation, leisure and other travel services to be provided on specified dates or during a specified period. The cancellation rights in section 15 apply.
The Client confirms that they are authorised to make the Booking on behalf of every person named on it and to provide the information reasonably required for those Travellers. The Client is responsible for communicating relevant contractual, practical and safety information to the group.
The Client must provide accurate names and any information reasonably required to deliver the Contract, and is responsible for ensuring that all Travellers understand and comply with these terms and with reasonable instructions given by UMF, guides, instructors, accommodation providers and other suppliers.
Unless UMF agrees otherwise in writing, the Client is responsible for paying all sums due under the Contract, including sums relating to other Travellers in the Booking.
If one or more Travellers cancel from a group booking, the cancellation charges in section 15 apply to the cancelling Traveller(s). Where the cancellation changes room occupancy, group size, transport allocation or another pricing basis, UMF may recalculate the price payable for the remaining Travellers to reflect the resulting direct change in supplier or service costs, and will explain the adjustment.
The price shown on the website or in a quotation may change before a Booking Request is submitted. Once the Contract is formed, the price is governed by the Contract and this section.
Unless the Booking Confirmation states otherwise:
• for bookings involving fewer than 16 Travellers, a Deposit of 25% of the total Package price is payable with the Booking Request;
• for bookings involving 16 Travellers or more, a Deposit of 25% is payable with the Booking Request and a further 15% of the total Package price is payable eight weeks after the Booking Confirmation; and
• the full remaining balance must be paid no later than six weeks (42 days) before the Departure Date.
For a Booking Request made 42 days or less before departure, the full price is payable with the Booking Request unless UMF agrees otherwise in writing.
If a payment is not received when due, UMF may give the Client a reasonable opportunity to pay. If payment remains outstanding, UMF may treat the Contract as cancelled by the Client and apply the cancellation charges in section 15, to the extent permitted by law.
Payment may be made by the methods offered by UMF. The Client is responsible for bank charges or card charges imposed by the Client's own bank or payment provider.
UMF may revise the price after the Contract is formed only where permitted by the French Tourism Code and only as a direct result of a change in: (a) the price of passenger transport resulting from fuel or other energy costs; (b) taxes or fees imposed by a third party not directly involved in performing the Package, including tourist taxes; or (c) relevant exchange rates. UMF will only exercise this right where the Booking Confirmation or other contractual document identifies the relevant reference cost, tax or exchange rate, the portion of the Package price affected and the calculation basis required by law. If those booking-specific calculation details are not provided, UMF will not increase the confirmed price under this section.
Any upward or downward revision will apply only to the portion of the Package price genuinely affected by the relevant change. For currency changes, the adjustment will be calculated by applying the percentage movement between the exchange rate used when the Contract price was established and the exchange rate applicable when the revision is calculated to the portion of the price purchased in that currency. For taxes, fees or transport-energy costs, the adjustment will equal the actual increase or decrease attributable to the Booking.
Any increase will be notified clearly on a durable medium, with the reason and calculation, no later than 20 days before departure. If the increase exceeds 8% of the total Package price, the Client will have the statutory rights applicable to a significant contract change, including the right to terminate without a cancellation fee. If this clause is used to increase the price, the Client is equally entitled to a corresponding reduction where the relevant costs decrease, less any actual administrative expenses that UMF is legally entitled to deduct.
Many UMF holidays involve outdoor, mountain or sporting activities. The holiday description may state minimum fitness, skiing, riding, swimming, climbing or other technical requirements. The Client is responsible for selecting a holiday appropriate to the abilities and experience of each Traveller and for providing accurate information when asked about fitness, experience, health or technical level.
A Traveller must inform UMF, before booking where reasonably possible and in any event as soon as known, of any medical condition, disability, allergy, dietary requirement or other circumstance that may materially affect participation or require a specific arrangement. UMF will consider reasonable requirements but cannot guarantee that every holiday or activity will be suitable for every Traveller.
Guides and instructors may refuse or stop a Traveller's participation in an activity where they reasonably consider that the Traveller lacks the required ability, fitness, equipment or behaviour to take part safely. Where the stated prerequisites were clear and the Traveller did not meet them, or provided inaccurate or incomplete information, no refund is due for the service missed as a result, except to the extent required by mandatory law.
Travellers must bring and use the clothing and personal equipment stated in the joining information and comply with safety instructions concerning technical equipment.
Each Traveller must have appropriate travel insurance for the Holiday, including medical expenses, repatriation and the activities included in the Holiday, with mountain rescue or evacuation cover where relevant. UMF also strongly recommends cover for cancellation, curtailment, personal liability and luggage. Where a specific activity or supplier requires particular insurance as a condition of participation, the Traveller must hold that cover and provide evidence if reasonably requested.
A European Health Insurance Card or equivalent health cover is recommended for eligible Travellers but is not a substitute for travel insurance.
If a Traveller suffers an accident, injury or illness during the Holiday, they must inform the guide, instructor, supplier or UMF as soon as reasonably possible so that appropriate assistance can be arranged.
Depending on the circumstances, this may include contacting the emergency services, helping the Traveller access medical care, providing information about local health services or authorities, contacting the Traveller's emergency contact, and assisting with communications or alternative arrangements.
Decisions concerning rescue, evacuation, medical treatment or whether a Traveller is fit to continue an activity may be made by the relevant emergency services, medical professionals, guide or instructor as appropriate.
The Traveller is responsible for the cost of medical treatment, rescue or evacuation, additional transport or accommodation, repatriation and any other expenses arising from accident, injury or illness. Travellers must therefore have appropriate insurance covering the activities included in their Holiday, including mountain rescue or evacuation and repatriation where relevant.
If the Traveller cannot continue all or part of the Holiday solely because of their own accident, injury or illness, services missed for that reason are not refundable by UMF. The Traveller should seek reimbursement from their insurer where their policy provides cover.
Where a Traveller's difficulty has been caused intentionally or through their negligence, UMF may charge a reasonable amount for the assistance provided, limited to the actual cost incurred by UMF.
The Client and each Traveller are responsible for ensuring that passports, identity documents, visas, health documentation and other travel formalities required for their circumstances are valid and completed in time. UMF will provide the general pre-contract information required by law but cannot determine every Traveller's individual immigration or entry requirements.
Unless the failure results from incorrect information supplied by UMF, UMF is not responsible for a Traveller being unable to participate because they do not have the required documents or permissions. The normal cancellation terms may apply.
Unless expressly included in the Holiday Contract, travel to and from the Holiday destination is arranged independently by the Client and is not part of the Package.
If the Client is unable to reach the Holiday because their independently arranged transport is cancelled, delayed or disrupted - for example because of an airline or rail cancellation, strike, missed connection, vehicle breakdown or similar travel problem - the Holiday remains subject to the normal Client cancellation terms. UMF is not responsible for refunding services missed as a result. The Client should seek reimbursement or assistance from the transport provider and/or their travel insurer.
An exception applies where exceptional and unavoidable circumstances occur at the Holiday destination or in its immediate vicinity and have significant consequences for the Holiday itself or for access to the destination. Examples may include a major wildfire affecting the Holiday area, evacuation orders, or access routes to the destination being closed by circumstances meeting that legal test. In those circumstances, the Client may cancel without cancellation charges and receive a full refund of payments made to UMF.
Where reasonably possible, UMF may offer an alternative Holiday, destination or departure date instead. The Client is not required to accept an alternative where they are entitled to cancel and receive a refund.
A Client may ask UMF in writing to amend the Booking. UMF is not obliged to accept an amendment where it is not reasonably possible or would materially affect the holiday, other Travellers or supplier arrangements.
If UMF accepts an amendment, the Client must pay any actual additional supplier or third-party costs caused by the change together with an administration fee of EUR 50 per person affected by the amendment, unless UMF agrees otherwise. If the amended arrangements cost less, any reduction will be dealt with in accordance with the agreed supplier terms and applicable law.
A request to make a material change 42 days or less before departure may be treated as a cancellation and rebooking where the requested change cannot reasonably be made as an amendment. UMF will explain this before applying cancellation charges.
Transfers of the Contract to another Traveller are dealt with separately in section 16.
UMF may make a minor change to the Package before departure where the Contract reserves that right, the change is insignificant and the Client is informed clearly on a durable medium. Examples may include a change of accommodation to a comparable standard in the same general area, a change in activity timing, a change of guide or instructor, or a minor itinerary adjustment.
If UMF must make a significant change to a main characteristic of the Package or cannot meet an accepted special requirement, UMF will inform the Client without undue delay and give the Client a reasonable period to choose whether to accept the proposed change or terminate the Contract without a cancellation fee. Where appropriate, UMF may offer a substitute Package. Any statutory price reduction or refund will be applied.
Outdoor and mountain holidays take place in changing natural environments. Weather, snow cover, avalanche risk, river levels, ice conditions, heat, storms, wildfire risk, trail, road or refuge closures, lift operations, local restrictions and other conditions can change quickly and cannot be guaranteed by UMF.
The Client accepts that routes, objectives, timings, accommodation and activities may therefore need to change. A change made for genuine safety, weather, access or operational reasons does not in itself mean that the Package has been cancelled or improperly performed.
The professional judgement of the guide, instructor or other person responsible for safety is final in relation to whether an activity or route may start, continue, be altered or be abandoned. No Traveller may require a guide or supplier to undertake an activity or route that the professional considers unsafe or inappropriate.
Where conditions prevent the original plan, UMF or the guide may provide a reasonable alternative taking account of safety, the nature of the holiday, availability, practicality and cost. For example, insufficient snow may require a different ski area, a different winter activity or a walking-based programme; rain may require a skills session, an alternative outdoor activity or, where available, use of an indoor climbing wall.
Where the holiday can continue but a safety or conditions-related change creates a new third-party cost that was not included in the original Contract - for example a taxi, additional refuge or hotel night, lift pass, entrance fee or equipment hire - that additional cost is payable by the Client. Wherever reasonably possible, the Client will be told the likely cost before it is incurred. If more than one reasonable alternative is available, UMF or the guide may explain the options and the cost of each. A no-cost alternative may be offered instead of a more expensive option.
The Client is not required to pay an additional charge where UMF is legally required to replace a contracted travel service that UMF has been unable to provide. In that situation, any appropriate replacement service that UMF is required by law to provide will be arranged without additional charge, and any applicable statutory price reduction will be respected.
UMF does not guarantee a particular summit, col, trail, piste, snow depth, frozen waterfall, water level, lift, refuge, route or precise sequence of activities unless the Contract expressly states otherwise. The purpose of guided outdoor holidays is to provide the contracted type and overall standard of experience while allowing qualified professionals to adapt plans to actual conditions.
Some holidays are sold with a fixed itinerary or fixed activity programme at the time of booking. In those cases, the activities and programme identified in the Contract are agreed from the outset, subject to UMF's rights to adapt them under section 13 and this section.
For certain multi-activity holidays, the Client chooses some or all activities after booking but before departure. Once the Client has finalised those choices and UMF has accepted them, the chosen activities form part of the agreed holiday content and cannot be changed by the Client except with UMF's prior written agreement.
For these multi-activity holidays, the Client's confirmed activity choices do not fix the day-by-day itinerary. UMF remains responsible for deciding and finalising the order, timing and location of the activities, normally during the week before departure, and may change them at short notice before or during the holiday. In doing so, UMF may take account of weather, mountain or water conditions, safety, supplier availability, opening times, access, travel times, group logistics and other operational factors.
Once an activity choice has been finalised, any request by the Client to remove, replace or swap that activity is a Client-requested amendment. Any such change is subject to UMF's prior agreement, availability and any additional supplier, third-party or administration costs. UMF is not obliged to accept the request.
If the Client decides not to take part in an activity that forms part of the agreed holiday content, no refund or credit is due. If the Client asks to do a different activity instead, the original activity is treated as cancelled by the Client with no refund, and any replacement activity requested by the Client is treated as an additional service and charged separately if UMF agrees to arrange it.
UMF may reschedule, modify or replace an activity where reasonably necessary because of weather, mountain or water conditions, safety considerations, supplier availability or other operational circumstances. A suitable comparable alternative may be provided instead; for example, via ferrata may be replaced by rock climbing where conditions make the original activity unsuitable.
Where the same activity can reasonably be carried out at another time during the holiday, UMF may move it to another day or time. Independent meals, visits, activities or other arrangements made by the Client do not restrict UMF's ability to rearrange the contracted holiday programme. If the Client chooses not to participate at the revised time because of an independent arrangement, no refund is due.
Where UMF cannot provide an agreed activity, cannot reasonably reschedule it and cannot provide a suitable alternative, UMF will provide the price reduction or refund attributable to that activity that is required by applicable law.
The Client may cancel the Contract at any time before departure by notifying UMF in writing. Cancellation takes effect when UMF receives the notice. The following standard cancellation charges apply because UMF incurs preparation, administration and supplier costs and may have limited ability to resell the cancelled services.

For an individual cancellation from a group booking, the percentage is normally applied to the price attributable to the cancelling Traveller, subject to any separate recalculation of the remaining group price under section 4.
These are standard cancellation charges intended to reflect the timing of cancellation, costs already incurred or committed, costs saved and UMF's ability to resell the services. Where required by law, UMF will justify the amount of the cancellation charge on request.
Any amount paid by or on behalf of the Client in excess of the applicable cancellation charge will be refunded within 14 days of termination of the Contract.
A Traveller may cancel without a cancellation fee where the French Tourism Code gives that right because exceptional and unavoidable circumstances occurring at the destination or its immediate vicinity have significant consequences for the performance of the Package or for passenger transport to the destination. In that case, the Traveller is entitled to a full refund of payments made for the Package within 14 days of termination, but not additional compensation.
The Client should notify their insurer promptly where the reason for cancellation may be covered by an insurance policy.
Before the holiday starts, the Client may transfer the Contract to another person who satisfies all conditions applicable to the Contract, by giving UMF reasonable notice on a durable medium. Notice given at least seven days before departure will normally be treated as reasonable.
The transferring Client and the replacement Traveller are jointly responsible for the remaining balance and the actual fees, charges and additional costs caused by the transfer. UMF will provide evidence of those costs on request, and they will not exceed the costs actually incurred by UMF as a result of the transfer.
UMF may cancel a Holiday before departure where:
• the number of participants is below the minimum number stated in the Special Terms and Conditions applicable to that Holiday; or
• UMF is prevented from providing the Holiday because of exceptional and unavoidable circumstances.
Where the minimum number of participants has not been reached, UMF will inform the Client no later than:
• 20 days before departure for Holidays lasting more than six days;
• 7 days before departure for Holidays lasting between two and six days; or
• 48 hours before departure for Holidays lasting no more than two days.
Before cancelling for insufficient participant numbers, UMF may, where reasonably possible, offer:
• an alternative Holiday or departure date; or
• the option for the Holiday to proceed with fewer participants, subject to payment of a supplement covering the additional cost caused by the shortfall.
Where a supplement is proposed, all affected Clients booked on that departure must agree to it in writing within the deadline specified by UMF. If unanimous agreement is not received, UMF may cancel the Holiday.
If UMF cancels the Holiday because the minimum number of participants has not been reached, or because exceptional and unavoidable circumstances prevent the Holiday from being provided, the Client will receive a full refund of all payments made to UMF for the cancelled Holiday within 14 days of termination of the Contract. No additional compensation is payable in these circumstances.
The Client is not required to accept any alternative Holiday, departure date or credit offered by UMF and may instead choose the refund described above.
UMF is not responsible for the cost of travel or other arrangements booked independently by the Client and not included in the Holiday Contract, including flights, trains, car hire, additional accommodation, airport parking, visas, insurance or other third-party services. Any cancellation or amendment costs relating to those arrangements remain the Client's responsibility.
Non-payment by the Client
If the Client fails to pay an amount due under the Booking by the applicable payment deadline, UMF may cancel the Booking after giving the Client reasonable notice and an opportunity to make the outstanding payment. In that case, the cancellation will be treated as a cancellation by the Client and the applicable cancellation charges in these terms will apply.
Each Traveller is responsible for their own conduct and must act lawfully, respectfully and reasonably towards other Travellers, residents, guides, suppliers, property and the natural environment. Travellers must comply with reasonable house rules, equipment-use rules, environmental restrictions and safety instructions notified by UMF or a supplier.
A Traveller is responsible for loss of or damage to accommodation, vehicles, hired equipment or other property caused by that Traveller, except to the extent the loss or damage is not attributable to them. The relevant accommodation or equipment supplier may require a security deposit and may pursue the Traveller directly under its applicable terms. UMF may also recover from the Client any amount that UMF is reasonably required to pay a supplier or third party because of damage caused by the Client or another Traveller for whom the Client booked.
Where UMF arranges equipment hire as part of the Package, the supplier's operational terms concerning collection, use, security, damage and return apply in addition to these terms. Those supplier terms do not remove any statutory rights the Traveller has against UMF in relation to a service that forms part of the Package.
Dangerous, abusive, unlawful or disruptive behaviour, deliberate damage, refusal to follow reasonable safety instructions or behaviour that puts people, property or the environment at risk may result in a Traveller being excluded from an activity or, where appropriate, from the remainder of the holiday. No refund is due for services missed as a consequence of the Traveller's own behaviour or failure to comply with reasonable safety instructions, except where mandatory law requires otherwise.
Smoking is prohibited in UMF vehicles and in any other location where the applicable supplier or law prohibits it.
From time to time UMF may, at the Client's request, help arrange a service that is not included in the Package, such as ski or bike hire, where the Client contracts directly with and pays the supplier directly. Where the booking documentation clearly identifies the service as separate, UMF's role is limited to facilitating the arrangement and the supplier's own contract and terms govern that service.
For a genuinely separate service contracted and paid directly with the supplier, the Client is responsible for payment, collection, use, return, deposits, damage and claims relating to that supplier contract, and UMF is not the contracting supplier of that service.
Nothing in this section is intended to reclassify a service contrary to the French Tourism Code. If, because of the way services are actually combined or sold, mandatory package-travel rules apply, those rules will prevail.
If a Traveller considers that a contracted service is not being provided correctly, they must tell UMF or the relevant local contact as soon as reasonably possible, taking account of the circumstances. For a problem that can be corrected during the holiday, the Traveller should report it immediately or as soon as it becomes apparent so that UMF has a genuine opportunity to investigate and put matters right.
Where UMF is notified of a non-conformity, UMF will seek to remedy it within a reasonable period where required and possible. Where a significant part of the Package cannot be provided as agreed, UMF will provide the alternatives, price reduction or other remedy required by applicable package-travel law.
A Traveller who waits until after the holiday to raise a problem that could reasonably have been reported and remedied during the holiday may prejudice UMF's ability to investigate or resolve it. Any effect this has on the Traveller's remedy will be determined in accordance with applicable law; this clause does not impose an artificial contractual limitation period shorter than the statutory period.
UMF will provide appropriate assistance to a Traveller in difficulty in accordance with the French Tourism Code. The practical arrangements for accidents, injury and illness are set out in section 8 above.
Where UMF sells a Package, UMF is responsible for the proper performance of the travel services included in that Package in accordance with the French Tourism Code, whether those services are performed by UMF or by another supplier. Nothing in these terms excludes or limits a mandatory statutory responsibility that cannot lawfully be excluded or limited.
Subject to mandatory law, UMF is not responsible for a failure, loss or damage to the extent it is attributable to: (a) the Traveller; (b) an unrelated third party whose act or omission was unforeseeable or unavoidable; or (c) exceptional and unavoidable circumstances.
Outdoor and sporting activities involve inherent risks that cannot be eliminated entirely even when properly organised and professionally supervised. Acceptance of those inherent risks does not remove UMF's statutory responsibilities, but a Traveller remains responsible for following instructions, acting within their ability and taking reasonable care for their own safety and property.
Travellers remain responsible for personal possessions except where applicable law provides otherwise. UMF recommends that valuable items are adequately insured and secured.
Where an international convention or other applicable law limits the conditions or amount of compensation payable by a travel service provider, the same statutory limits may apply to UMF to the extent permitted by the French Tourism Code.
Where UMF accepts a Booking involving a minor travelling without a parent or other authorised adult, the Client must provide the information required by law to enable direct contact with the minor or the person responsible for the minor at the destination.
The parent, legal guardian or responsible organisation must ensure that appropriate adult supervision and all necessary authorisations are in place. Specific safeguarding, school, club or group terms may also apply.
UMF has financial insolvency protection with Groupama Assurance-Crédit & Caution, 3 Place Marcel Paul, 92000 Nanterre, France, under guarantee contract no. 4000718720/0. The guarantee is provided in accordance with the applicable provisions of the French Tourism Code.
UMF holds professional civil liability insurance with Groupama Méditerranée, ZAC de Pichaury, 24 Parc du Golf, BP 10359, 13799 Aix-en-Provence Cedex 3, France, policy no. 50 968 364 G 0002. The policy includes professional civil liability cover for UMF as a travel organiser/seller and receptive travel agency specialising in mountain holidays.
If a complaint has not been resolved during the holiday, the Client should send a written complaint to UMF as soon as reasonably possible after return, setting out the relevant facts and supporting documents. Complaints can be sent to [email protected] or to UMF at 26 rue de la Carrière, 05130 Jarjayes, France.
UMF will seek to respond within a reasonable period. A consumer who has first made a written complaint to UMF and remains dissatisfied may refer an eligible dispute free of charge to the Médiateur Tourisme et Voyage (MTV - Médiation Tourisme Voyage, CS 30959, 75383 Paris Cedex 08, France) in accordance with the mediator's current rules and procedures published at www.mtv.travel.
Nothing in this section prevents either party from exercising any right to bring proceedings before a competent court after any mandatory or agreed pre-litigation process has been followed.
UMF processes personal data for the purposes of enquiries, bookings, contract administration, safety, supplier coordination, payments and legal obligations. Information necessary to deliver the Booking may be shared with the relevant accommodation providers, guides, instructors, transport providers, activity suppliers, payment providers, insurers, public authorities or other service providers as appropriate.
Health, dietary, disability or other sensitive information will be handled only where necessary and in accordance with applicable data-protection law. Further information is set out in UMF's Privacy Policy.
Where UMF sells gift cards, the validity period and any specific conditions will be stated on the gift card or at the time of purchase. Unless stated otherwise, a gift card is valid for 12 months from issue for a holiday taking place within 24 months of issue, is usable once and is not redeemable for cash, subject to any mandatory rights that apply.
Use of a gift card is subject to availability and to the Booking Terms in force when the holiday is booked.
UMF takes reasonable care to keep website and pre-contract information accurate. Photographs, maps, route illustrations, piste plans and similar visual material are illustrative unless expressly stated to form a guaranteed part of the Contract. Natural conditions, maintenance, local restrictions and supplier decisions may affect what is available at the time of travel.
A material item of pre-contract information that forms part of the Contract will not be treated as merely illustrative simply because it appears on the website.
The Contract is governed by French law, without depriving a consumer of any mandatory protection that applies under the law of their habitual residence where such protection cannot lawfully be excluded.
If any provision of these terms is invalid or unenforceable, the remaining provisions continue to apply. An invalid provision will be interpreted or replaced only to the minimum extent necessary to comply with applicable mandatory law.
The French and English versions are intended to have the same substantive meaning. Where a legally unavoidable discrepancy remains, the French version will prevail, subject to any mandatory consumer-law rule to the contrary.
